The Securities and Exchange Commission (SEC) has lodged a motion opposing Ripple’s request to dismiss Andrea Fox’s statement, according to defense lawyer James K. Filan. The SEC submitted the motion in line with the court’s recent schedule. Last week, Ripple filed a motion asking the court to disregard the SEC’s testimony and evidence presented by Fox in support of its opening remedies brief. Ripple argued that Fox should have submitted her declaration during the discovery phase, while the SEC claimed she was a summary witness. The SEC has now asked the court to reject Ripple’s request, stating that Fox is indeed a summary witness and did not offer any specialized opinions in her report. The court’s ruling on Fox’s classification will determine whether her declaration will be struck. Ripple is expected to respond to the SEC’s opposition on May 2, addressing the arguments raised and presenting counterarguments.
